MASTER USER AGREEMENT

This Master User Agreement (“Agreement”) constitutes a legally binding contract between You (“User,” “Patient”) and RSX Hospital (“Company,” “We,” “Us”). By creating an account, accessing our Platform, entering our Physical Facilities, or utilizing our AI Diagnostic Tools, you unequivocally agree to be bound by these terms.

RSX reserves the right to amend these terms at any time without prior specific notice to you. The latest version will always be posted on the Platform. Continued use constitutes acceptance of the amended terms.

Refers to the integrated service model where care is delivered through a seamless combination of Digital AI Agents (Online) and Physical Infrastructure/Doctors (Offline).

Refers to proprietary algorithms, Large Language Models (LLMs), and Computer Vision systems deployed by RSX to triage symptoms, interpret radiology, and suggest differential diagnoses.

A medical condition manifesting itself by acute symptoms of sufficient severity (including severe pain) such that the absence of immediate medical attention could reasonably be expected to result in placing the individual’s health in serious jeopardy.

Our AI Agents use probabilistic modeling to suggest diagnoses. While trained on vast medical datasets, AI is prone to “Hallucinations” (errors). The User agrees that AI suggestions are for information/triage purposes only and do not constitute a final medical verdict until verified by an RMP (Registered Medical Practitioner).

By using the “DeepScan” feature, you consent to the algorithmic analysis of your biometric features (face, gait, skin texture). You warrant that you are physically present and the images captured are of your own person or a minor under your legal guardianship.

Services are available only to persons who can form legally binding contracts under applicable law. Minors (under 18) may only use the service under the account and direct supervision of a Parent/Legal Guardian.

You are responsible for maintaining the confidentiality of your credentials. Any medical activity (e.g., prescriptions ordered) occurring under your account is deemed to be authorized by you. RSX is not liable for data leaks resulting from compromised User passwords.

Virtual Consultations are limited to non-emergency conditions. RSX Doctors (Human or AI) cannot treat severe trauma, active bleeding, or cardiac arrest via the app. In such cases, the App will auto-direct to the nearest Emergency Room.

Prescriptions issued via the Platform are valid legal documents. However, RSX reserves the right to deny prescriptions for Narcotic/Psychotropic substances via Telemedicine, in compliance with the NDPS Act and Telemedicine Guidelines.

You agree NOT to:
a) Upload fraudulent medical reports to test/trick the AI.
b) Use abusive language towards Human Doctors or Support Staff.
c) Attempt to reverse-engineer the AI source code.
d) Record video consultations without the explicit consent of the doctor.

RSX reserves the right to permanently suspend accounts found violating Clause 6.1. In cases of abuse towards medical staff, RSX will report the user to law enforcement agencies.

All fees for consultations (AI or Human) are due immediately. We utilize third-party payment gateways (Stripe/Razorpay). We do not store credit card details directly.

– AI Consultations: Non-refundable once the report is generated.
– Human Consultations: Refundable if the Doctor fails to join the call within 15 minutes of the scheduled time. No-shows by the Patient are non-refundable.

RSX Hospital provides evidence-based medical care but does not guarantee a cure for any specific ailment. Medicine is an evolving science, and outcomes vary by individual.

RSX is not liable for delays in care caused by internet outages, server failures, or device incompatibility on the User’s end during a Telemedicine session.

To the fullest extent permitted by law, RSX Hospital’s total liability for any claim arising out of these terms or the use of the services shall not exceed the total amount paid by the User to RSX in the twelve (12) months preceding the event giving rise to the claim.

RSX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, resulting from your use of the AI Diagnostic tools.

You agree to defend, indemnify, and hold harmless RSX Hospital, its officers, directors, AI developers, and employees from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Platform, including providing false medical history which leads to incorrect AI diagnosis.

Any dispute, controversy, or claim arising out of this Agreement shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be New Delhi, India. The language shall be English.

You agree that any arbitration or proceeding shall be limited to the Dispute between us and you individually. To the full extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any Dispute to be arbitrated or resolved on a class action-basis.
